Would the egg and cream cheese mixture hold up well enough without the gelatin?

Is there any issue with leaving the patties in the freezer for longer than 30 min - say, overnight?

As someone who hates the texture imparted by gelatin, I would certainly try it without. Maybe freeze the mixture longer before dredging and frying?
