Contest Period:
The Food52 Instagram of the Week Photo Contest (the “Contest”) starts on Friday, 10/28/16 on or after 12:00AM Eastern Time (ET), in correspondence with Instagram kickoff post and announcement post on Food52, and ends exactly at 12:00 AM ET on the following Friday, 11/4/16 (the "Contest Period").

Eligibility:
NO PURCHASE (OF ALCOHOL OR ANY OTHER PRODUCT) NECESSARY TO ENTER. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE RESTRICTED OR PROHIBITED BY LAW. THIS PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM. MULTIPLE ENTRY DEADLINES APPLY.

This Contest is open to any registered member of www.instagram.com, United States residents, 21 years of age or older, as of date of entry. Any persons involved in the creation, development, or implementation of this Contest; and any other persons or entities directly associated with this Contest and any members of their immediate families or households are ineligible for entry. Entries for the Contest must be received prior to the expiration of the Contest Period. This Contest is subject to all federal, state, and local laws and regulations. VOID IN ALASKA, HAWAII AND WHERE PROHIBITED BY LAW. By submitting an entry, entrants agree to abide by these Official Rules and all applicable federal, state, and local laws and regulations that govern the Contest.

Employees of the following entities and members of their families or households are not eligible for participation under any circumstances: Diageo Americas, Inc., Food52, their respective affiliates, printers, advertising and promotion agencies, alcohol beverage suppliers, importers, wholesalers, distributors or retailers. 

How to Enter:
To enter the Contest, you must be a registered member of Instagram. If you are not a registered member of Instagram, please visit www.instagram.com to register for a free account. (A compatible mobile device is required to use the Instagram platform.)

You may enter the Contest by performing the following steps:
1. Upload original photo of your Moscow Mule creation.Use of Smirnoff Vodka in your Moscow Mule is NOT required.
2. Tag the Instagram photo with #f52grams and #SmirnoffMuleContest, and write a caption describing what was made.
3. Follow @SmirnoffUS on Instagram (if you do not already).

You must include the hashtag #SmirnoffMuleContest in your photo. In accordance with applicable law, the use of the hashtag #SmirnoffMuleContest serves to disclose to the public that, in sharing your Moscow Mule creation on Instagram, you are entering a contest for Smirnoff Vodka for a chance to win a prize from Diageo Americas, Inc. as the sponsor of the contest. If the hashtag #SmirnoffMuleContest is omitted from your Moscow Mule creation, your Contest entry is subject to disqualification by Sponsor.

All Submissions must be received by 12:00 AM ET on 11/4/16. There is a limit of one (1) Submission per person; and, a given person may only enter the Contest by using one (1) Instagram account.The person submitting the Entry must be the authorized account holder of the Instagram account associated with the Entry and the original content creator.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.instagram.com or other websites, applications or social media platforms (including Food52 and websites, applications and social media platforms used by Diageo Americas, Inc. and/or its Smirnoff Vodka brand). Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. All Submissions will be reviewed for content before being published. While certain Submissions may be featured from time to time on the Website during the Contest Period, , if an entrant’s Submission is a featured Submission does not constitute any representation that the entrant responsible for such Submission is either eligible for the Contest or has been selected as a prize winner in the Contest.

Sponsor and Food52 are not responsible for technical difficulties, telephone or cell phone service disruptions or other equipment or service issues which might affect a person's ability to post a Submission on Instagram and qualify or the ability of the Sponsor to notify the winners. Sponsor and Food52 also assumes no responsibility for lost, late, damaged, misdirected, illegible, incomplete, incorrect, inaccessible Submissions or other Contest materials, all of which are void. All entries become the property of the sponsor and will not be returned.

Agreement to Official Rules:
By participating in the Contest, Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrators, which are final and legally binding in all matters related to the Contest. Such decisions include but are not limited to whether an Entrant’s Submission is in compliance with these Official Rules and is eligible for the Contest.

Promotion Terms of Submission:
As conditions of entry into this Contest and by uploading a Submission, each Entrant represents and warrants that their entire Submission: (a) is wholly original; (b) has been created solely by the Entrant listed upon Submission; (c) has been legally obtained and/or created; (d) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party or violate applicable laws, regulations or network standards; (e) they have not granted or transferred any rights in or to the Submission to any third party prior to the date of Submission; and (f) Entrant has not done anything which has impaired and will not do anything to impair the rights granted to Food52 and/or Sponsor in any way.


Entering a Submission in the Contest grants Sponsor and its designees (including Food52) the right to use, publish, adapt, edit and/or modify the Submission in any way, in whole or in part, and to use such Submission, and any ideas or concepts contained therein, in commerce and in any and all media now known or hereafter discovered, worldwide, without limitation or compensation to the entrant and without right of notice, review or approval of any such use of the Submission.

Photos containing full or partial nudity, defined as the display of the genitals, pubic area, vulva, anus, or anal cleft with less than a fully opaque covering or the showing of the breast with less than a fully opaque covering of any part of the nipple, or any lewd or sexually suggestive gesture will be disqualified. No photo or any text included therein shall (a) depict or reference persons consuming alcoholic beverages (b) depict or reference persons conducting themselves in an inappropriate manner (c) contain material that would imply that the consumption of alcoholic beverages is acceptable before or while operating machinery, driving a vehicle or undertaking any other activity that requires a high degree of alertness or physical coordination, (d) contain any material that would degrade or demean the human form, image or status of women, men or the members of any group based on race, religion, ethnic background, sexual orientation or any other minority status, or (e) include an image of or reference to any person that appears to be under 21 years of age. Obscene, provocative, lewd or otherwise objectionable content or those which reflect poorly on the Smirnoff Vodka brand will not be considered and the determination of the appropriateness of any photo and any text included therein submitted is at the sole discretion of the Sponsor and/or Food52.

CONTEST SUBMISSIONS POSTED BY ENTRANTS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE ENTRANTS THEMSELVES AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION THEREWITH.

Prizes:
Prizing will be provided by Sponsor to regrammed users throughout the contest period. If the user does not respond to request for mailing information or any other contact initiated by contest Administrator or Sponsor within seven (7) days of selection, prize will be forfeited and/or offered to runner up. Winners will be contacted by Administrator and/or Sponsor about prizing, if offered, within three (3) days of Contest end.

Prize Packaging
Regrammed users will receive one (1) Stainless Steel Cocktail Shaker from the Food52 Shop and one (1) pair of copper Moscow Mule Mugs from Diageo. Approx. Retail Value: $65 each. The grand prize winner will receive one (1) Rift Cut White Oak Ice Bucket from the Food52 Shop. Approx. Reatail Value: $250. Retail Value of All Prizes: $315.

Selection of Winner:
Winners will be selected by Food52. Daily Prize winners will be selected from all eligible Submissions received on a given day of the Contest Period as well as non-winning eligible Submissions from previous day(s) of the Contest Period. Grand Prize winner will be selected from all eligible Submissions received during the Contest Period. In all cases, the selection of winners will be based on the arbitrary, personal taste of representatives of Food52. For Daily Prize winners, the selection for a given day will be made on or about the next business day. For Grand Prize winner, the selection will be made on or about 11/7/2016. Odds of winning a Daily Prize depend on the total number of eligible Submissions received up to and including that day of the Contest Period and the vagaries of Food52’s taste. Odds of winning the Grand Prize depend on the total number of eligible Submissions received during the Contest Period and the vagaries of Food52’s taste.

Potential winners will be notified within three (3) days of selection, through direct message and/or comment on Instagram. IT IS THE POTENTIAL WINNER’S SOLE RESPONSIBILTY TO ASSURE THAT HIS/HER INSTAGRAM PRIVACY SETTINGS ARE CONFIRMED SO AS TO RECEIVE NOTIFICATIONS FROM DIAGEO AMERICAS, INC.’S SMIRNOFF VODKA BRAND. The potential prize winners will be required to respond within seven (7) days and return completed affidavit of eligibility, a liability release and a publicity release (where lawful), accompanied by valid government-issued photo identification (e.g., driver’s license), or prize will be forfeited and may be awarded to an alternate winner (in Sponsor’s sole discretion). Prize will only be delivered to addresses within the continental United States.

Release:
Unless prohibited by law, as a condition of entry, you grant consent to Food52, Diageo Americas, Inc., and their agents to use your name, likeness, voice, biographical information and/or your Entry for publicity or advertising in any media or manner, without further payment, consideration, notice or approval and without geographic or time limitation.

By entering the Contest, you voluntarily and knowingly completely and forever release, waive and discharge Sponsor and all related parties, Food52, and Instagram, from and against any and every kind of claim, demand, injury, costs, attorney fees, right, liability or cause of action or other liabilities of whatever kind or nature, known or unknown, absolute or contingent, and whether or not fixed, which you ever had, now has or might in the future have arising in any way or related to this Contest, including, but not limited to, participation in the Contest; your Contest Submission; use of your name, likeness, biographical information, signature, image or likeness; prize winner’s receipt, use or inability to use any prize or part thereof, including but not limited to injury or loss sustained in any travel related to the prize; financial claims; physical and/or emotional injury; and/or any other legal claim that may arise, whether under contract, tort, warranty or any other theory or claim.

Terms + Conditions:
If a prize or prize notification is returned to Food52 as undeliverable or if an entrant is found to be ineligible or declines acceptance of a prize for any reason, such potential winner forfeits all rights to the prize and an alternate winner may be selected (in Sponsor’s sole discretion).

Income and other taxes, if any, are the sole responsibility of each winner. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of prize.


Except at the sole discretion of Sponsor, prizes are non-transferable and cannot be substituted. Prizes have no cash value if not used.

Food52 and/or Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner.

Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Contest at any time without notice or further obligation.

Disputes:
In the event of a dispute as to any winner, the person who owns the e-mail address associated with the winning Instagram account will be deemed the winning entrant. Potential winners may be required to show proof of identification.

Governing Law:

All disputes and questions regarding the construction, validity, interpretation and enforceability of these Official Rules, or concerning the rights and obligations of any participant and/or Food52 and/or the Sponsor, shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than New York. The invalidity or un-enforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of these Official Rules is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained there.

By submitting a photo using #f52grams, entrant is agreeing to comply with and abide by all Terms and Conditions and Contest rules, as stipulated above. Food52 and/or Sponsor reserve the right to disqualify any entrants or winners, at any point during or after Contest term, if they are not in compliance with the above Terms and Conditions and Contest rules.
