The Contest is sponsored by Rémy Cointreau USA, Inc., with an address of 1290 Avenue of the Americans, New York, NY 1014, (the “Sponsor”).

This Contest is open to any registered member of www.instagram.com, United States residents, 21 years of age or older, as of date of entry. This Contest is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, Twitter, or other media properties. You are providing your information to Rémy Cointreau USA, Inc. (“Sponsor”). Any persons involved in the creation, development, or implementation of this Contest; and any other persons or entities directly associated with this Contest and any members of their immediate families or households are ineligible for prizing. Entries for the Contest must be received prior to the expiration of the Contest Period. This Contest is subject to all federal, state, and local laws and regulations. By submitting an entry, entrants agree to abide by these Official Rules and all applicable federal, state, and local laws and regulations that govern the Contest. To enter the Contest, you must be a registered member of Instagram. If you are not a registered member of Instagram, please visit www.instagram.com to register for a free account. (A compatible mobile device is required to use the Instagram platform.)

You may enter the Contest by performing the following steps:

1. Upload original photo of your awards-themed cocktail creation along with the recipe. Each cocktail must have at least .75oz of Cointreau included
2. Tag the Instagram photo with #TheArtOfTheMix and #f52contest, and @cointreau_us
3. Follow @cointreau_us and@food52 on Instagram (if you do not already) in order to win

You must include the hashtag #TheArtOfTheMix and #f52contest in your photo. In accordance with applicable law, the use of the hashtag #TheArtOfTheMix and #f52contest serves to disclose to the public that, in sharing your awards-inspired creation on Instagram, you are entering a contest for Cointreau for a chance to win a prize from Rémy Cointreau USA, Inc. as the sponsor of the contest. If the hashtag #TheArtOfTheMix and #f52contest is omitted from your awards-inspired cocktail creation, your Contest entry is subject to disqualification by Sponsor.

All Submissions must be received by 11:59 PM ET on 2/24/19. There is a limit of one (1) Submission per person; and, a given person may only enter the Contest by using one (1) Instagram account.The person submitting the Entry must be the authorized account holder of the Instagram account associated with the Entry and the original content creator.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.instagram.com or other websites, applications or social media platforms including Food52 and websites, applications and social media platforms used by Rémy Cointreau USA, Inc. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. All Submissions will be reviewed for content before being published. While certain Submissions may be featured from time to time on the Website during the Contest Period, if an entrant’s Submission is a featured Submission does not constitute any representation that the entrant responsible for such Submission is either eligible for the Contest or has been selected as a prize winner in the Contest.

Sponsor and Food52 are not responsible for technical difficulties, telephone or cell phone service disruptions or other equipment or service issues which might affect a person's ability to post a Submission on Instagram and qualify or the ability of the Sponsor to notify the winners. Sponsor and Food52 also assumes no responsibility for lost, late, damaged, misdirected, illegible, incomplete, incorrect, inaccessible Submissions or other Contest materials, all of which are void. All entries become the property of the sponsor and will not be returned.

By participating in the Contest, Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrators, which are final and legally binding in all matters related to the Contest. Such decisions include but are not limited to whether an Entrant’s Submission is in compliance with these Official Rules and is eligible for the Contest. By participating and/or accepting a prize, entrants, winners, and guests acknowledge and agree that this Contest is in no way sponsored, endorsed, or administered by, or associated with, Facebook, or Twitter and agree to release and hold harmless Facebook, and Twitter, Sponsor, Sponsor’s advertising and promotional agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors (“Released Parties”) from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever, including, without limitation, property damage, personal injury, and/or death that may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance, and/or use or misuse of prize or participation in any Contest-related activity, including, but not limited to, any claims based on publicity rights, defamation or invasion of privacy, and merchandise delivery. Sponsor shall not be responsible for any cancellations, delays, diversions, substitutions, or omissions whatsoever by any transportation companies or any other persons providing any services to winner, including any results thereof, such as changes in services or location necessitated by same. Sponsor is not responsible if any part of a Contest prize cannot be awarded due to acts of God, acts of war, natural disasters, weather, or acts of terrorism. Sponsor shall not be liable for any loss or damage to personal belongings. Entrants who do not comply with these Official Rules or who attempt to interfere with this Contest in any way shall be disqualified.

As conditions of entry into this Contest and by uploading a Submission, each Entrant represents and warrants that their entire Submission: (a) is wholly original; (b) has been created solely by the Entrant listed upon Submission; (c) has been legally obtained and/or created; (d) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party or violate applicable laws, regulations or network standards; (e) they have not granted or transferred any rights in or to the Submission to any third party prior to the date of Submission; and (f) Entrant has not done anything which has impaired and will not do anything to impair the rights granted to Food52 and/or Sponsor in any way.


Entering a Submission in the Contest grants Sponsor and its designees (including Food52) the right to use, publish, adapt, edit and/or modify the Submission in any way, in whole or in part, and to use such Submission, and any ideas or concepts contained therein, in commerce and in any and all media now known or hereafter discovered, worldwide, without limitation or compensation to the entrant and without right of notice, review or approval of any such use of the Submission.

One grand prize winner will be selected to win an all-expenses-paid trip for 2 to the Cannes Film Festival in May 2019. The 7 finalists will be featured in an editorial Food52 article.

The approximate retail value ("ARV") of the grand prize is $15,000. The grand prize includes transportation (including airfare), hotels, meals, attending the festival, visiting bars, and a distillery tour in Angers. The grand prize winner will be visiting the cities of Cannes, Angers, and Paris throughout their trip. All costs and expenses not specifically described in these Official Rules are the responsibility of the Winner. The actual retail value of the Prize may vary depending on the Winner’s residence, market conditions, changes in value of components (e.g. air transportation and hotel rates) and other reasons. The Sponsor is not responsible for and the Winner will not receive the difference between the actual value of the Prize at the time of award and the stated ARV. The Prize does not include taxes, travel insurance, bag fees, telephone charges, personal expenses, gratuities, service charges, hotel room service, laundry service, merchandise, souvenirs, site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules. All travel and accommodations will be booked through Sponsor and are subject to availability.

The Winner is solely responsible for determining and obtaining, at his/her own expense, required travel documents. Certain travel and security restrictions may apply, and it is the responsibility of the Winner to comply with all travel, security and other laws, regulations, and airline passenger rules that apply to them. The Sponsor is not responsible for airline cancellations, blackout dates, delays, diversions or substitutions and no refund or compensation will be awarded in any such event. The Sponsor is not liable for any missed events, opportunities or expenses incurred as a consequence of flight cancellation/delay. Travel may be subject to weather changes and conditions and changes outside the control of the Sponsor. The Sponsor is not responsible if all or any portion of the Prize is delayed, postponed or cancelled for any reason, in which event that portion of the Prize is forfeited in its entirety and no substitution will be provided, except in the Sponsor’s sole discretion. The Sponsor is not responsible or liable in any manner if the Winner is unable to accept or use all or any portion of the Prize due to failure to qualify or comply with these Official Rules or any law, regulation or other rules that apply to acceptance, receipt or use of the Prize. The Sponsor will not replace any lost, mutilated or stolen tickets, travel vouchers or certificates. The Prize is not transferable. < br />
Prizing is to be solely provided by Sponsor to the 7 finalists and 1 grand prize winner. If the user does not respond to request for mailing information or any other contact initiated by contest Administrator or Sponsor within seven (7) days of selection, prize will be forfeited and/or offered to runner up. Winners will be contacted by Administrator and/or Sponsor about prizing, if offered, within seven (7) days of Contest end.

All local, state and federal taxes incurred by accepting a prize will be the sole responsibility of the prize winner. Any person winning over $600 in prizes during any one (1) year period will receive an IRS Form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS. USE OF E-MAIL ADDRESSES By participating in this Contest, an Entrant agrees to opt-in to receive e-mail communications from the Sponsor.

Sponsor and its affiliates reserve the right to use winner recipe & photo (custom shot by Food52).

Winners will be selected by a panel of judges from members of Food52 and Rémy Cointreau USA, Inc. The 7 finalists will be selected from all eligible Submissions received on a given day of the Contest Period as well as non-winning eligible Submissions from previous day(s) of the Contest Period. The 7 finalists will be judged on their original cocktail recipe and the imagery of the cocktail recipe. Grand Prize winner will be selected from all eligible Submissions received during the Contest Period. In all cases, the selection of winners will be based on the arbitrary, personal taste of representatives of Food52 and Rémy Cointreau USA, Inc. For Daily Prize winners, the selection will be made on or about 3/1/2019. For Grand Prize winner, the selection will be made on or about 3/1/2019. Odds on becoming one of the seven finalists depend on the total number of eligible Submissions received up to and including that day of the Contest Period and the vagaries of Food52’s taste. Odds of winning the Grand Prize depend on the total number of eligible Submissions received during the Contest Period and the vagaries of Food52’s taste.

Potential winners will be notified within three (3) days of selection, through direct message and/or comment on Instagram. IT IS THE POTENTIAL WINNER’S SOLE RESPONSIBILITY TO ASSURE THAT HIS/HER INSTAGRAM PRIVACY SETTINGS ARE CONFIRMED SO AS TO RECEIVE NOTIFICATIONS FROM RÉMY COINTREAU USA, INC. The potential prize winners will be required to respond within seven (7) days and return completed affidavit of eligibility, a liability release and a publicity release (where lawful), accompanied by valid government-issued photo identification (e.g., driver’s license), or prize will be forfeited and may be awarded to an alternate winner (in Sponsor’s sole discretion). Prize will only be delivered to addresses within the continental United States.

Unless prohibited by law, as a condition of entry, you grant consent to Food52, Rémy Cointreau USA, Inc., and their agents to use your name, likeness, photograph, voice, biographical information and/or your Entry for publicity or advertising in any media or manner, without further payment, consideration, notice or approval and without geographic or time limitation. All potential winners of prizes with a value of $600 or more will be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release. All potential winners of prizes with a value of less than $600 will be required to sign and return, where legal, a Declaration of Eligibility and Liability/Publicity Release. All documents must be returned by potential winners within one (1) day of notification that he/she is a potential winner. No potential winner will be an official winner until his/her Affidavit or Declaration of Eligibility and Liability/Publicity Release] has been returned and eligibility has been formally verified by Sponsor. If any potential winner fails to comply with these Official Rules and/or to submit the required documentation within the designated time period, he/she will be automatically disqualified and the prize may be awarded to an alternate winner.

- If a prize or prize notification is returned to Food52 as undeliverable or if an entrant is found to be ineligible or declines acceptance of a prize for any reason, such potential winner forfeits all rights to the prize and an alternate winner may be selected (in Sponsor’s sole discretion).

- Income and other taxes, if any, are the sole responsibility of each winner. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of prize.

- Except at the sole discretion of Sponsor, prizes are non-transferable and cannot be substituted. Prizes have no cash value if not used.

- Food52 and/or Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner.

- Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Contest at any time without notice or further obligation.

In the event of a dispute as to any winner, the person who owns the e-mail address associated with the winning Instagram account will be deemed the winning entrant. Potential winners may be required to show proof of identification.

All disputes and questions regarding the construction, validity, interpretation and enforceability of these Official Rules, or concerning the rights and obligations of any participant and/or Food52 and/or the Sponsor, shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than New York. The invalidity or un-enforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of these Official Rules is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained there.

By submitting a photo using #TheArtOfTheMix and #f52contest, entrant is agreeing to comply with and abide by all Terms and Conditions and Contest rules, as stipulated above. Food52 and/or Sponsor reserve the right to disqualify any entrants or winners, at any point during or after Contest term, if they are not in compliance with the above Terms and Conditions and Contest rules.
