making Merrill's crispy choc chip oatmeal cookies, and even at 10 mins., they are still soft on top. I used 2 cups oats.

Hard to say. Maybe your oven runs a little cool.
Also, the recipe calls for three cups of oats. By only using two cups, you made the dough more moist than usual. I'm guessing that's a contributing factor.
